![]() JUDGE WILLIAM J. HIBBLER CHICAGO-(AEAE)-ILLINOIS DISTRICT COURT JUDGE WILLIAM J. HIBBLER ISSUED AN ORDER ON 10/02/2009 stating," The Court DENIES Appellant's Motion for Reconsideration. As indicated on Pure Fishing's Certificate of Service, Pure Fishing served Appellant with a copy of its motion to dimiss". Stoller claimed that he never received a copy of the pure fishing Motion and that Judge Hibbler had "no" jurisdiction. Judge Hibbler wrote ,"The Court lacked jurisdiction is unfounded..." "The fact that a party mails a document creates a rebutable presumption that the addressee actually received the mailing" Hagen v. US . However, it is NOT conclusive evidence that the receiving party actually received the mailing. Stoller will ask the Seventh Circuit Court of Appeals to decide the case today by filing his Appeal. The only way an attorney will ever get respect form a District Court Judge is to appeal and have that Judges decision reversed. That is why lawyers who engaged in Appellate Practice take so many years to win the respect of trial court judges.... Pete Pekulis 10/05/2009 6:49am
