JUDGE WILLIAM J. HIBBLER
CHICAGO-(AEAE)-ILLINOIS DISTRICT COURT JUDGE WILLIAM J. HIBBLER ISSUED AN ORDER ON 10/02/2009 stating," The Court DENIES Appellant's Motion for Reconsideration. As indicated on Pure Fishing's Certificate of Service, Pure Fishing served Appellant with a copy of its motion to dimiss". Stoller claimed that he never received a copy of the pure fishing Motion and that Judge Hibbler had "no" jurisdiction. Judge Hibbler wrote ,"The Court lacked jurisdiction is unfounded..." "The fact that a party mails a document creates a rebutable presumption that the addressee actually received the mailing" Hagen v. US . However, it is NOT conclusive evidence that the receiving party actually received the mailing. Stoller will ask the Seventh Circuit Court of Appeals to decide the case today by filing his Appeal.
