CHICAGO-(AEAE)-THE THIRD U.S. CIRCUIT COURT OF APPEALS RULES THAT POLICE CAN NOT MAKE A WARRANTLESS ENTRY INTO A HOME UNDER THE GUISE OF COMMUNITY CARETAKEERS. The court, in Ray v. Township of Warren, 09-4353 "In the context of the search of a home, it does not override the warrant requirement of the Fourth Amendment or the carefully crafted and well-recognized exceptions to that requirement….” The sanctity of the home is a deeply embedded tradition and preventing physical entry of it is the chief purpose of the Fourth Amendment, the COURT added. CHICAGO-(AEAE)-THE 5TH CIRCUIT COURT OF APPEALS DETERMINED THAT A WELL KNOWN HOUSTON ATTORNEY SHOULD BE RETRIED ON WIRE FRAUD, MONEY LAUNDERING AND CONSPIRACY. There is not a day that goes by when prominent lawyers are not charged with major felonies and civil Racketeering. In another story the well known law firm of Bryan Cave LLC and its senior partner Steven R. Smith and his “bag man” Michael Werich have been charged with Indirect Criminal Contempt for perjury and subornation of Perjury involving a Cook County Judge Mary Ann Masson, who refused to allow the Indirect Criminal Contempt Petition to be filed. It is believed that Judge Marry Ann Mason was engaged in a “cover up” to protect the Bryan Cave LLC law firm according to a Judicial Inquiry Board Complaint.

CHICAGO-(AEAE)-JUDGE WILLIAM H. YOHN JR RULES THAT EXPERT TESTIMONY NOT SUPPORTED BY LITURATURE IN THE FIELD CAN BE ALLOWED TO BE RELIED UPON AT TRIAL

Justice Department lawyers tried to win dismissal of the suit by challenging two expert witnesses.

Since both experts were essential to proving the case, the government argued, a ruling that excluded either one would also mandate dismissal of the suit on summary judgment.

“ Yohn has ruled that experts are both "reliable" and that their testimony "fits" the case as those terms were defined by the U.S. Supreme Court in the seminal decision Daubert v. Merrill Dow .” Full Story Conflict With Medical Literature Fails to Sink Expert's Testimony

Smith will never agree to any thing and only has one word in his vocabulary “No”. Today Mr. Steven R. Smith was asked to consent to an extension of time because the opposing representative could not be present for the Dec. 8, 2010 hearing. When Mr. Steven R. Smith was asked if he would consent he said, “No!” Afterwards the representative said to Mr. Steven R. Smith, “Have a nice thanksgiving.” Mr. Steven R. Smith responded “No!” One partner from Bryan Cave who refused to give his name, said recently, “Steven R. Smith would make Charles Dickens' proud playing Ebenezer Scrooge. Smith even looks like Scrooge!”

CHICAGO-(AEAE)-COOK COUNTY SHERIFF THOMAS DART WHO HAS JUST WON RELECTION TO ANOTHER FOUR YEARS IN OFFICE, WAS TOLD BY THE COOK COUNTY STATES ATTORNEY Anita Alverez to start enforcing eviction orders signed by judges. Cook County Thomas Dart halted eviction for five weeks because of the mortgage fraud that Bank of America has engaged in by filing fraudulent foreclosure documents in order to defraud home owners out of their property according to charges by numerous Attorney Generals through the Country. However Anita Alverez has ordered Thomas Dart to start evicting people from their homes despited the fact that many of these court orders were based upon fraudulent mortgage foreclosure documents. After all the Cook County States Attorney Anita Alverez wants these foreclosure victims thrown out of their homes before Thanksgiving this week! The voters of Cook Country should throw Anita Alverez out of office the next time that she runs for re-election to the Cook County States Attorney according to a Mexican priest who did not want to give his name, who's mother is on the foreclosure list. CHICAGO-(AEAE)-THE OBAMA ADMINISTRATION HAVING TAKEN A BATH AS THE 2010 interim elections having lost the House of Representatives to the Republicans, have dug in to show the people that they know how to lead. With the recently controversy over air line pilots and passengers who are now being forced to submit to fully body scans before entering a commercial air plan, Obama has personally solved this problem. As of January 1, 2010 any pilot or passenger who has a problem with submitting to a full body scan before being allowed to enter a commercial air craft, will have the option to board a separate air craft in which passengers are not scanned or checked for anything. The Middle Eastern Countries have heralded Obama plan to set up separate air craft for passengers to fly jets where the passengers are not scanned or checked for anything. To Prove Defamation Case?
What Do You Have To Prove? There are two things you have to prove to be true in order to win a case of defamation of character in the court of law. First of all, you have to prove without a doubt that what was said or written about you is not true. Once you have proved that the statement is, in fact, false you have to prove that the other person said the false statement with the intent of causing you some form of harm.
The Fair Reporting Privilege is a defense to any claim of Defamation

The Fair Report Privilege applies to the information contained on this web site.

“[T]he fair report privilege has two requirements: (1) the report must be of an official proceeding; and (2) the report must be complete and accurate or a fair abridgment of the official proceeding. [Citation.] *** For a publication to be considered a fair abridgment, the report must convey to readers a substantially correct account of the official proceedings.
