  CHICAGO-(AEAE)- CHARLES CLEMENTS, 69, KILLS JOSHUA FUNCHES, 23, as a result of his dog urinating on Clements lawn. Clements is found guilty of second degree murder. Illinois Criminal Court Judge Daniel Rozak sentenced Clements to serve four years of probation. Full Story: No prison for man whose dog urinated on lawn - Herald News

SUPREME COURT DECISION IN PADILLA V. KENTUCKY CHANGES THE ROLE OF CRIMINAL DEFENSE LAWYERS

  CHICAGO-(AEAE)-THE U.S SUPREME COURT FOUND IN Padilla v. Kentucky, 08–651, that the role of the criminal defense lawyer in their failure to give proper advise to a client when explaining the consequences or lack there of when accepting a guilty plea, can lead to reversal of a conviction because of ineffective counsel. “In this post conviction proceeding, Padilla claims that his counsel not only failed to advise him of this consequence prior to his entering the plea, but also told him that he "`did not have to worry about immigration status since he had been in the country so long.'" 253 S.W.3d 482, 483 (Ky.2008). Padilla relied on his counsel's erroneous advice when he pleaded guilty to the drug charges that made his deportation virtually mandatory. CHICAGO-(AEAE)-THE SHERIFF OF COOK COUNTY, THOMAS DART WAS SUED FOR MALICIOUS PROSECUTION. Bank of America, Bank of New York Mellon Trust, Wells Fargo all  have become defendants. The tide has turned against Banks for fraudulent mortgage foreclosure law  suits. A series of attorneys, Bryan Cave LLC were also named as party defendants.
ALTHOUGH CHARGES  HAVE BEEN BROUGHT in various cases, looking forward to defending them in court and to a favorable result!

  CHICAGO-(AEAE)-IN A REPORT THAT WAS JUST RELEASED BY WIKILEAKS, IT STATED THAT SANTA CLAUS WAS ACTUALLY KILLED IN June 6, 2005. That an impostor Santa was used in the years since 2005, 2006, 2007, 2008, 2009, 2010. Last night the impostor Santa was shot down by the Iranians. Today a report out of the North Pole merely confirms the Wikileaks release of confidential North Pole documents last night. According to the leaked documents, Santa was murdered by “evil” woman, who did not want the children of the world to receive any gifts from a “father” figure, when she had deprived her children from their father's love and affection, according to the leaked documents. The woman, a close friend of Mr. Ebeneser Scrooge, had denied the charges and her case is still under investigation by the North Pole Police Department. When Mr. Scrooge was asked to comment, his lawyer Mr. Robert Shylock, from the well known North Pole Criminal law firm of Shylock and Shylock, who represents both Scrooge and the accused woman, said, “There is a pending investigation and Mr. Scrooge cannot comment at this time.”

  CHICAGO-(AEAE)-EVERY YEAR SINCE THE BEGINNING OF AEAE IT HAS TRACKED SANTA'S JOURNEY EVERY CHRISTMAS. Tonight AEAE will do it again. It used to be that any entity that choose to track Santa's journey needed millions of dollars of equipment. Well that's not true today. An entity needs a million dollars of equipment not “millions”.

Everyone will recall that last Christmas 2009 AEAE reported that Santa ran into some bad weather, was not paying attention, was texting and crashed some where over Russia under some what mysterious circumstances. Some Muslim was seen running from the crash site with a shoulder fired missile devise, but the Russians denied any involvement other than to say that Santa was not given permission to use Russian Air Space. Furthermore Russians deny the existence of any “Santa Claus” or that there is any thing known as Christmas. In any event stay tuned. The weather report over the north pole is bad tonight, but that will not stop Santa. It is now believed that the Russians shot down a decoy Santa sleigh not the real Santa.

CHICAGO-(AEAE)-AT THE END OF EACH YEARS SINCE 1974 the Americans for the Enforcement of Attorney (AEAE), a Chicago based attorney ethics watch dog group, rates the worst lawyers in the United States. Who will they be this year?  With over 1 million people who call themselves lawyers in America, there is "no" shortage of "bad" "mal practicing" and "corrupt" lawyers. In fact there is not a day goes by that some attorney is not charged with a major criminal act or charged with professional misconduct. AEAE will release the names of attorneys who have made the AEAE 2010 list of the most unqulaified attorneys in America. Please stay tuned.
SIDEBAR: This week was extremely busy. Court appearences each day before new judges who who constasntly act like that they do not know what the law is. In fact most judges will not enforce the "law" on behalf of a pro se party, if that party is not aware of his rights or the law that supports his position. Judges  in their opinion will not act on behalf of such a unrepresented party nor will they give any legal procedural information. "Let the pro se litigatnt beware!"

  CHICAGO-(AEAE)-IN AN INTERVIEW WITH JULIAN ASSANGE, THE FOUNDER OF WikiLeaks indicated that Bank of America and their law firm of Bryan Cave LLC will be the next target. “Thousands of Bank of America documents, communications with their lawyers Bryan Cave LLC will be exposed on Wikileaks.org with no polite requests for executives responses or other forewarnings.” In side the Securities and Exchange Commission, the organization is bracing for a public out cry according to people who have recently spoken with high-ranking officials about the prospect of WikiLeaks releasing bank documents. “There will be resignations and mortgage corruptions charges!” The question AEAE asks, “Will their be documents with the attorney names of Steven R. Smith and his bag man Michael Werich?
SIDEBAR: Today Illinois Lake County Judge Stark set a briefing schedule in the Civil Rico Lawsuit against  Illinois Attorney Michael Gauthier, the Officials of Cuba Township, Barrington Illinois, a divorce lawyer and a child representative. Michael Gauthier attempted to get the case dismised on Nov. 16, 2010 with an exparte court order. However, Judge Stark set a hearing on a motion for reconsideration and motion to consolidate for February. "Your Lake County case was dismissed!" "No baby its back!

WAS sentenced to life in prison when his mal practicing lawyers plead Bernie guilty to a life sentence. Just a week ago Mr. Madoff lost is oldest son 46 to suicide on the second anniversary of Mr. Madoff guilty plea. Now the trustee and federal prosecutors have reached a $7.2 billion settlement, reportedly the largest civil forfeiture in U.S. History, recovering funds to pay the creditors of Bernie Madoff. In fact about 50% of the valid claims against Madoff will be paid.      To Prove Defamation Case?
    What Do You Have To Prove? There are two things you have to prove to be true in order to win a case of defamation of character in the court of law. First of all, you have to prove without a doubt that what was said or written about you is not true. Once you have proved that the statement is, in fact, false you have to prove that the other person said the false statement with the intent of causing you some form of harm. 
    The Fair Reporting Privilege is a defense to any claim of Defamation 

    The Fair Report Privilege applies to the information contained on this web site.

    “[T]he fair report privilege has two requirements: (1) the report must be of an official proceeding; and (2) the report must be complete and accurate or a fair abridgment of the official proceeding. [Citation.] *** For a publication to be considered a fair abridgment, the report must convey to readers a substantially correct account of the official proceedings.
