ILLINOIS JUDGE McGRATH TO HEAR MOTION FOR PARTIAL SUMMARY JUDGMENT IN THE BANK OF NEW YORK CASE

CHICAGO-(AEAE)-ILLINOIS CIRCUIT COURT JUDGE McGrath TO HEAR MOTION FOR PARTIAL SUMMARY JUDGMENT IN THE STOLLER V. BANK OF NEW YORK MELLON CIVIL RICO ACTION. Bank of New York Mellon and Bank of America are facing a 14 count Civil Racketeering lawsuit which also names their attorneys the Firm of Bryan Cave LLC, Senior Partner Steven R. Smith and his bang man attorney Michael Werich. Then in the afternoon Chief Judge of the Law Division Judge Maddox is set to hear a motion to transfer the case from the the Law Division to the Chancery Division to Judge Mary Ann Mason. There has been three motions filed before Judge Mary Ann Mason to disqualify her for cause. Bryan Cave thus want to bring the New York Mellon Case before their Judge Mary Ann Mason in Chancery because Bryan Cave LLC is alleged to have a relationship with Judge Mason. Who also has on three occasions denied a Petition for Indirect Criminal Contempt to be filed against Bryan Cave attorney Steven R. Smith and his “bag man” Michael Werich. On or about Dec. 23, 2009, in a telephonic call Steven R. Smith made the statement, “I know Judge Mason and she will not put up with you're nonsense!” This conversation was recorded. In February Steven R. Smith filed a sworn affidavit stating that “did not make the statement that “I know Judge Mason and she will not put up with you're nonsense!” Steven R. Smith sworn under oath that he did not make that statement. A petition for Indirect Criminal Contempt was filed before Judge Mary Ann Mason, who refused on at least three occasions to allow the Indirect Criminal Contempt to be even filed. According to charges Bryan Cave had a “fix” in so as to not allow the Indirect Criminal Contempt Petition to be filed in front of Judge Mason, according to a Judicial Inquiry Board - Complaint that is being filed against Judge Mary Ann Mason.
It was later learned that Bryan Cave LLP has numerous case involving the discredited Countrywide Bank in front of Judge Mary Ann Mason. Mason has been on the bench in Cook County Illinois since 2000. Her Husband Michael Mason is a magistrate Judge in the Northern District of Illinois.

SIDEBAR: The Americans for the Enforcement of Attorney Ethics AEJE judicial watch dog group has rated Judge Mary Ann Mason Unqualified ever since she came on the bench in 2000.
UPDATE: Judge McGraph entered and continued the motions. Bryan Cave LLP withdrew its motion to transfer before Judge Maddox. Hearing set for next week on Bank of New York Motion to Dismiss.
