![]() CHICAGO-(AEAE)-THE LEGAL PRINCIPLE KNOW AS mens rea, which held that people must know they are committing a crime before they can be found guilty of a crime, has been eliminated. This principle was held valid for centuries. Mens rea is a Latin term for a “guilty mind.” Recent convictions of many business and political leaders has clearly established that mens rea no longer applies. Further Law makers have drafted laws which ignore the notion of criminal intent or mens rea. In other words most high profile and low profile convictions of individuals today to not even require that the party who is alleged to have committed the crime had any intent to commit a crime. The danger of convicting individuals who do not know they are committing crimes is greatest among the developmentally disabled who are easy targets for government prosecution. These people cannot not even defend their acts in court. It is very easy to day to go to jail and very hard to win one's freedom.
