Twitter Makes Deal for 'Tweet' Mark

"Twitter now has the rights to "tweet." Twittad, an online advertising company, has transferred trademark rights to the word "tweet" to Twitter in exchange for a dismissal of its trademark infringement suit over Twittad's trademarked phrase "Let Your Ad Meet Tweets."

I remember hearing that somebody bought some good trademarks (including STEALTH, SENTRA, CHESTNUT, ANNIHILATOR, TERMINATOR, STRADIVARIUS, COLLIDER, HAVOC, and DARK STAR LAGER) at a bankruptcy sale for $7,500. A real pittance for those great marks. I guess the new owner can legally sell STEALTH® brand baseball bats and excercise balls. And bow ties, too. And I think I will go make a movie called STEALTH ANNIHILATOR! This is going to be fun.

Trademark Registrations are not necessary to police trademark use. The cancelation of a trademark registration does not mean that an trademark owner can not sue or use a particular mark. Furthermore there applications pending which give notice to all parties that they should not attempt to infringe some one trademarks. The trademark game is not as simple as some would like to believe. Unless a party is a "black belt" in the trademark game.....

What Do You Have To Prove? There are two things you have to prove to be true in order to win a case of defamation of character in the court of law. First of all, you have to prove without a doubt that what was said or written about you is not true. Once you have proved that the statement is, in fact, false you have to prove that the other person said the false statement with the intent of causing you some form of harm.
