
The Peta lawsuit claims that Sea Worlds five Orca whales were being held against their will, were enslaved and were entitled to the protections under the 13th Amendment of the U.S Constitution, which bans slavery and involuntary servitude. The court had banned Peta's claim stating that Peta had “No Standing” in that they were not appointed guardian's for the Orca whales and that Peta must first seek a guardian ship petition in a Probate Court before their suit could be entertained. Corky, the most out spoken of the Orca whales, stated that he “did not want Peta to become his guardian and would oppose any guardianship petition.
Corky said, “I am being well feed and I like entertaining the customers at Sea World Shows. It is far more fun then roaming the ocean aimlessly.”
