SECOND REQUEST FOR SUBSTITUTION OF JUDGE GERALD BENDER MEETS WITH A FRIVOLIOUS MOTION TO DISMISS

_  CHICAGO-(AEAE)-THE FILING OF A SECOND MOTION TO SUBSTITUTE ILLINOIS CIRCUIT COURT JUDGE GERALD BENDER MEETS WITH A FRIVILIOUS MOTION TO DISMISS AND SANCTIONS .”Petitioner moves this Court to dismiss with prejudice the frivolous, unwarranted and harassing petition entitled “Second Motion for Substitution of Judge Gerald C. Bender and for sanctions for the filing of a false, frivolous and unwarranted pleading in violation of Supreme Court Rules...even if the allegations in the pleadings and affidavits by the Respondent are viewed as true, which they are not.” It is obvious that the Petitioner does not view the conduct of a judge who fails and refuses to hear an noticed motions from April of 2010 to the current date, as grounds to disqualify a judge. The Petitioner does not obviously view Judge Gerald C. Bender clear violations of the due process rights of the respondent, who has appeared before Judge Gerald C. Bender for over 6 months and in those six months Judge Bender has refused to entertain any motion filed by the Respondent. According to the Petitioner this is the conduct of a fair and impartial judge and the suggestion that the Respondent should attempt to seek a change of judge should be subject to sanctions. How reasonable? What the Petitioner's attorney fails to tell the court that his legal training came from a Russian law school that taught that a Respondent should just be grateful that he doesn't just get a bullet in the back of his head while sitting in a court room.

Bu the matter at hand is you and judge Bender.

Why would anyone want to see a dirtbag like you treated fairly?

As for the motion you can count on getting your petition dismissed, all the judges hate you. There is no justice for you piggy, get used to it. Everyone lets you squak and strut then your crap gets tossed......just like a dirty rubber.

I see that the Supremes have denied another of your petitions. This one must hurt because it was from the Seventh Circuit's filing bar sanction and the holding that you are a perjuror.

Obviously some people have not experienced Judge Bender's wrath. It is probably just that he is in his new courtroom. He can no longer tell a father he only needs to see his child once a year. Direct quote from the not so honorable judge gerald c bender. May he be tormented in hell forever.

     To Prove Defamation Case?
    What Do You Have To Prove? There are two things you have to prove to be true in order to win a case of defamation of character in the court of law. First of all, you have to prove without a doubt that what was said or written about you is not true. Once you have proved that the statement is, in fact, false you have to prove that the other person said the false statement with the intent of causing you some form of harm. 
    The Fair Reporting Privilege is a defense to any claim of Defamation 

    The Fair Report Privilege applies to the information contained on this web site.

    “[T]he fair report privilege has two requirements: (1) the report must be of an official proceeding; and (2) the report must be complete and accurate or a fair abridgment of the official proceeding. [Citation.] *** For a publication to be considered a fair abridgment, the report must convey to readers a substantially correct account of the official proceedings. [Citation.] A reporter is not privileged to make additions of his own that would convey a defamatory impression or to indict expressly or by innuendo the veracity or integrity of any of the parties.
