MONTANA-YELLOWSTONE NATIONAL PARK FILED A RADEMARK INFRINGMENT LAWSUIT AGAINST AN ALLEGED INFRINGER “Yello Stone “Natural Park. Yellowstone National Park became concerned when a out of town business man acquired 3000 acres directly across from Yellowstone park and opened Yello Stone Natural Park. The competitor brought in 3000 head of bison, bears, wolfs and a few ecosystems. Yellowstone claimed that it 146 year old trademark was confusingly similar to the new junior user Yello Stone. However however what saved the day for the defendant was the expert testimony of the greatest trademark expert witness in the world who testified that “although Yello Stone is the phonetic equilificant of Yellowstone, Yellowstone does have a W that distinguishes its mark form Yello Stone. In addition the trademark expert testify that after 146 years Yellowstone was “generic” for state parks and that therefore Yellowstone National Park could no longer claim its mark was an exclusive source identifier. The jury bought the Expert's testimony and granted judgment for Yello Stone and also fined the Yellowstone National Park sanctions fees and cost totaling $298.091.00. The Yellowstone park director said, “They completely ripped us off!”

Hah.. Nice one, LEO. The likelyhood of confusion here is the same that would take place between the Stealth brand bowties you once claimed to market and George Brett's Stealth brand baseball bats. Of course, you lost that case both in Illinois District Court and lost yet again on appeal with the Seventh Circuit!
