Once an application is submitted to the U.S. Copyright Office, according to the latest federal appeals court to weigh in on an increasingly divisive issue. A 9th Circuit panel ruled this week that the submission of the application, rather than the Copyright Office's grant of registration, dictates when a copyright is officially registered. The 9th Circuit joins the 5th and 7th circuits in deciding for the application approach, while the 10th and 11th circuits concluded. CHICAGO-(AEAE)- A HEARING IS SET TODAY TO MOVE FOR THE DISQUALIFICATION OF ILLINOIS ASSOCIATE JUDGE Judge Naomi H. Schuster . Judge Schuster was assigned to hear the disqualification of Illinois Circuit Court Judge Gerald Bender. However her own bias and prejudice was evidenced at the very first hearing on May 27, 2010 when for no apparent reason insisted that the hearing to disqualify Judge Bender take place on a date and time in which Stoller had another hearing before Judge Preston. A motion for Substitution of Judge (SOJ) was immediately filed. The hearing is set for this morning. Will Judge Schuster recuse herself or will a hearing have to be set to substitute a Judge for a Judge who was suppose to hear the first substitution of judge motion? Stay tuned. He was 74. CHICAGO-(AEAE)-A MANDAMUS ACTION HAS BEEN FILED AGAINST THE ILLINOIS APPELLATE COURT FIRST DIVISION FOR DISMISSING 4 appeals in violation of due process and equal protection. A mandamus action is a procedure when a governmental body must be ordered by a Superior Court to perform a task which they refuse to perform on there own. The mandamus action has been filed with the Illinois Supreme Court requesting that the High Court in Illinois “order” the Illinois Appellate Court to re-instate several appeals which the Illinois and the U.S. Constitution grant the rights to citizens to appeal. In another case there is a Writ of (Cert U.S. Supreme Appeal) pending against the Seventh Circuit Court of Appeals. At every level of inter personal communications in the legal system, from State Courts all the way to the Supreme Court, when individual judges, appellate courts fail to abide by the Constitution parties are forced to move up the food chain and go to the high court. There is great injustice in this country. The struggle to maintain a parties constitutional rights which all of our soldiers who have died to maintain, is a constant battle that must be fought every day. No one should ever assume that any decision that is rendered by a judge or an appellate court is correct until it has passed the test of a higher court review.
